Should you choose to use TAG Heuer’s virtual try-on tool (“VTO”), we would like to provide you some information regarding how it works (“VTO Notice and Consent”).
By using this VTO and clicking “I agree”, you will give access to your webcam or phone camera (depending on the device you are using) and the VTO will, for the sole purpose of offering you the best try-on experience possible, locate your facial landmarks so it can digitally display the item on your face properly. Your image is only processed live and only for the duration of your try-on session by a third-party named Fittingbox, whose software enables the VTO experience. TAG Heuer does not collect, store, or have access to your image or any data derived from it, such as the location of your facial landmarks, or any other personal data about your VTO usage. FittingBox will irreversibly erase your image and any data derived from it, such as the location of your facial landmarks, upon completion of your VTO session (under typical circumstances, approximately 5 minutes).
You will have the option, if you elect to do so, to download on your device the result of your VTO experience (picture of you with the product worn). TAG Heuer does not have access to such picture(s).
You therefore acknowledge that your agreement to the terms set forth herein and consent to this VTO Notice and Consent is a prerequisite to the use of the VTO. Please note that we will ask you to consent again to this VTO Notice and Consent every time your session expires and you want to use the VTO again. This VTO Notice and Consent supplements, and does not supersede or otherwise obviate, our Privacy Policy and Terms of Use which remain fully applicable. Should you access third-party websites or services other than FittingBox when using the VTO, we remind you that these third-party websites or services are outside our control and responsibility and thus not subject this VTO Notice and Consent.
Using this VTO implies you discharge and release TAG Heuer, to the fullest extent permitted by applicable laws and regulations, from any liability whatsoever and from all claims arising out or relating to the use of this VTO.
TAG Heuer reserves the right to amend this VTO Notice and Consent from time to time at its sole discretion. Such amendments will be effective and will further apply to your use of the VTO subsequent to their publication.
Additional terms for our customers located in the United States
Some parties have asserted that the data collected by VTO tools constitutes “biometric identifiers” or “biometric information” under the laws of certain states, including but not limited to Illinois, Texas, and Washington. Residents of those states or any states with similar laws should carefully review this VTO Notice and Consent and understand that clicking “I agree” constitutes their written agreement to the collection of the data described in this VTO Notice and Consent, regardless of whether that data in fact constitutes a “biometric identifier” or “biometric information” under state law.
Jury trial waiver for customers located in the United States
By clicking “I agree,” you agree that in any dispute by or among you and one or both of TAG Heuer and FittingBox that arises out of or is related to the VTO tool, all parties irrevocably waive any right to a trial by jury that they may otherwise have had.
